Palm Beach County Man Accused of Exposing Himself to Teens
A Delray Beach man has been arrested and accused of exposing himself to a group of teenagers twice, both on and off school grounds, according to police.
The 25-year-old man was arrested Tuesday on charges of lewd and lascivious exhibition and violation of probation, according to a Delray Beach police arrest report.
The investigation started early Tuesday after the man allegedly exposed himself to four students, ranging in age from 14 to 16, when the students were walking to their middle school.
The students claim they saw the man walking toward them while he was exposed. They said the man did not try to talk to them, but did make eye contact as he passed by.
The students entered the cafeteria once on school grounds, and claim they saw the same man as they exited the cafeteria by the bike racks, and that he was still exposed.
At 9 a.m. Tuesday, a School District police officer asked police to help find the man.
A description was given and nearly 20 minutes later, a police officer found a man who matched the description on a sidewalk.
The officer took the man to the school officer, who confirmed he was the person who exposed himself on the school premises, according to the report.
The man was taken to the Delray Beach Police Department, where he allegedly told police there were two times in the morning where he realized he was exposed and that “he fixed” his clothing so that his genitalia was no longer was showing, according to reports.
Police claim the man told them that “he usually wears his pants sagging,” which he said could be the reason he was exposed.
He remained at the Palm Beach County Jail late Wednesday without bail.
While most people know that exposing oneself in public, especially to minors, is a crime, most fail to realize that this is classified as a sex crime, carrying serious consequences, including possible lifetime sex offender registration.
To prove you are guilty of committing this crime, the prosecution must show that you willfully exposed your genitals in the presence of another person or persons AND that at the time of exposure, you acted lewdly by intending to direct attention to your genitals in order to sexually gratify yourself or another person or to offend another person or persons sexually.
Depending on the facts of your case, our Florida Sex Crimes Defense Lawyers at Whittel & Melton may be able to argue that you did not expose yourself on purpose. We may be able to effectively argue that your exposure was neither sexually motivated nor did it carry the objective of gratification or to offend others.
